Hmmm... I agree... His words are very tricky.

In his ad in CL, he said that its passed smog and currently registered. So, if I'm a potential buyer, I would assume that it is legal because it passed smog and registration. right?

I also agree that there is a possibility of a hook-up.

what I believe is that a vehicle cannot be registered if it failed smog test (visual, functional, etc.)

I wonder if he smogged it in a gold shield test only center

Hey Manny, on that note, I reckon even if or when they make you pop your hood, they have no idea what to look for anyways, correct? When a cop finally asked me to pop my hood rather than ask me as before, he was just starring in there like he didn't know what to think. Then he was like "Any engine modifications?" I was like "Nope" and he just nodded his head while still starring in wonder as if he was trying to find WALDO as I shut the hood! LOL

So that made me a bit confident that so long as I do not act a fool, I will be alright once it's swapped.
