I was in town this weekend because I was promised that the car would be done, but of course, it wasn't. Instead, I found a new large mark on the door, and found out that one of my nice wheels is scratched. What really irritated me was that I dropped off my old wheels months ago and my mechanic said he'd put them on so that my nice wheels wouldn't get damaged, but he was too lazy to even do that! >mad.gif>

The other day, he called me and told me that he couldn't finish the swap again, due to not having some information. So I called my friend, and he talked to his buddy who's really good with engine swaps and stuff. He said it wouldn't be a problem to finish my car up, but then he went down to Auto Boogie, looked at my car, and said that it was messed up beyond repair and that he wouldn't even touch it because of what my mechanic had done to it. >frown.gif>

So I called my parents, only to find out that they won't let me go to court, because they're worried about insurance finding out about the swap. Also, they think I deserve this for doing an engine swap in the first place. >rolleyes.gif>

Everything is just going downhill right now...>frown.gif>

That is just a bad situation. On the bright side...even though it's hardly existent herer, we all know not to do business with Auto Boogie.

Coomer- Check with insurance, but I think most companies are okay with having a swap. It shouldn't change your insurance, I talked to my statefarm agent, and he not only said that it wouldn't change my insurance rate, but if I kept all the reciepts, whatever work I put into it would also be insured.

Check with your insurance company, it might not be a problem, then you can take them to small claims. also, I've found sometimes just a letter from a lawyer is enough to scare some people into giving you what they owe you.

He has a point... most insurance companies dont care, or dont know enough to care. And anything that is "permanently installed" is insured, grant it you have full coverage
Why you had no reason to declare to the insurance company the swap was done untill it was compleated and you where gona put it on the road. No laws where broken.
I just called my insurance company and asked if they'd insure a '94 Celica with the AE101 4A-GE engine swap, and they said it wasn't insurable. >frown.gif>

I think I'm going home later today for the weekend, so maybe I'll be able to talk to my dad's friend who is a really good laywer and see what he has to say. I know he deals more with criminal law, but hopefully he can point me in the direction, and maybe he can talk to my parents as well, since he's a friend of the family.

First, I would like to just congratuations on this site. I admire the civilised community that inhabits a small corner of the cyberworld. Keep up the good work everyone!

Although I do not own a 6th generation Celica, I nevertheless browse these forums from time to time.

This topic, which was raised by a friendly poster, struck a cord with me and therefore I have decided to (i) get registered and (ii) post for the first time.

I hope you all don't mind me taking up a little bit of virtual space.

Back to this topic - I recommend commencing with legal proceedings however small. However, before you do this, you should obtain some evidence which I am sure it is easy to get as he seems to a serial liar.

Once you have all the evidence (photographs, tapes, etc), you should start writing letters to the company (if you can, find out the legal name of that entity) (i) confronting him of the problem and (ii) ask him to remedy the situation by a set date, informing him if no remedial action has been taken, you will take this claim to the small claims tribunal.

Such a letter (of which you keep a copy) proves to the adjudicator that you are acting reasonable which provides a better chance of success for you.

There should be a variety of places as someone suggested (e.g. small claims court) which should help you.

I appreciate that your parents are scared of your insurance but I cannot see how this repair is related to your insurance. Even if your insurance finds out you have done a swap, all they can do is cancel your insurance contract. It doesn't affect the damage that the repair shop company actually has done to your car. In other words, your insurance should not have any effect on you going to court.

Obviously, I agree that you should talk to your dad's friend but in the end, I really do think you should take some sort of proceedings against.

It would be a shame to let such a repair shop get away with it as I am sure they have got away with doing this for such a long time.
